At the outset, learned Counsel appearing for the respective parties submitted that parties have filed separate consent terms, however, in the order dated 9th January 2015, inadvertently, it has remained to be mentioned that consent terms are "separate". In the circumstances, second sentence in the said order is corrected to read as under : "Parties to the appeal have settled their dispute amicably and have filed separate consent terms."

The Appellant and the Respondent have filed separate consent terms. Separate consent terms are required to be filed as the Appellant is residing at Dubai and it is not possible for him to attend this Court. The consent terms of the Appellant are affirmed before the Consulate General of India at Dubai. The Respondent is present before the Court. She patilsr 1 / 2

admits the contents of her consent terms. Both the sets of consent terms are taken on record and respectively marked as "X-1" and "X-2" for identification. Undertakings given therein are accepted.

The learned Counsel appearing for the respective parties submitted that Clause-V of the Respondent's consent terms dated 7th January 2015 which corresponds with Clause-IV of the appellant's consent terms has been duly complied with. The learned Counsel appearing for the respective parties submitted that in view of the above, appeal be disposed of in terms of the consent terms.

In the light of above, the appeal is disposed of in terms of the consent terms. Decree be drawn up accordingly. 5.

In view of the disposal of main Family Court Appeal, applications taken out in this FCA does not survive and same are accordingly disposed of.
