This is an application for anticipatory bail in connection with C.R.No.248 of 2019, registered with Jogeshwari Police Station, Mumbai, for the ofences punishable under Sections 406 and 420 of Indian Penal Code ("IPC", for short). First Information Report ("FIR", for short) was lodged on 23rd December, 2019.

The case of the prosecution is that the applicant had purchased Molex CAT 6 cable from the complainant in July 2018 for his IT business. He issued cheque in sum of Rs.4,17,248/-, which were dishonoured. The amount is not paid.

rpa 2/3 938-aba-562-2020.doc Complainant has initiated proceedings under Section 138 of Negotiable Instruments Act, 1881, before the Court of Metropolitan 49th Court at Andheri, Mumbai on 6th June, 2019. Learned counsel for the applicant submits that the trial Court has taken cognizance of the said complaint and process has been issued. The complaint is at the stage of recording evidence of the complainant. The FIR has been lodged subsequent to initiating proceedings under the provisions of Section 138 of Negotiable Instruments Act, 1881. The dispute is in relation to sale of goods and the amount involved according to the complainant is to the tune of Rs.4,17,248/-.

Considering the nature of transaction, custodial interrogation of the applicant is not necessary. Hence, I pass the following order:

:: O R D E R ::

(i) Anticipatory Bail Application No.562 of 2020, is allowed;

(ii) In the event of arrest of Applicant in connection with C.R.No.248 of 2019, registered with Jogeshwari Police Station, Mumbai, he be

rpa 3/3 938-aba-562-2020.doc released on bail on his executing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;

(iii) Applicant shall report the investigating oficer on 19th and 20th March, 2020, between 11:00 a.m. to 01:00 p.m., till fling of the charge - sheet;

(iv) Anticipatory Bail Application No.562 of 2020, stands disposed of accordingly.
