1) By an order dated 1.3.2017 the applicant was granted interim relief.
2) It is the allegation against the applicant that the applicant who was conducting classes/tuition for teaching the people about share market business, had published an advertisement about the same. That, by accepting Rs.5000/- from the complainant the applicant gave tuition to him. That, as the complainant was not comfortable with the learning after the first session/tuition, the applicant thereafter allowed him to attend the two further sessions, free of costs. After taking tuition from the applicant the complainant opened D-mat account in his own name and started doing the business of stock market trading. He suffered certain loss and therefore, lodged the present crime against the applicant.
2 /2ABA-329-17-20 3) As stated earlier after accepting payment of Rs.5000/- as tuition fees /training fees from the complainant the applicant has imparted training on three occasions/sessions to the complainant. The complainant has suffered loss in stock trading market in his individual capacity and not due to the inducement and or any false promise given by the applicant. Prima facie, it appears that the complainant has lodged the said complaint as pressuring tactics to extract money from the applicant. 4) In view of the above, the applicant has made out a case for his release on pre-arrest bail. Interim relief granted by an order dated 1/3/2017 is hereby confirmed however, the condition to attend the police station is hereby waived.
