The learned Counsel appearing for the Respondent-Bank make statement that this matter is basically arising out of the public notice dated 16 January 2016 and auction dated 22 February 2016. No writs were issued and therefore, issued a fresh notice already on 8 November 2016 in respect to one property. The petition though filed on 20 February 2016, yet there is no order of interim relief and/or protective relief granted in favour of the Petitioner.

In view of this, we are inclined to dispose of the present petition as it becomes infructuous. The petition is disposed of accordingly, as infructuous. No costs.
