This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No. 305 of 2022 registered at Neral Police Station, Dist. Raigad for the ofence punishable under Section 381 of the Indian Penal Code. 3.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 4.

According to the prosecution, the co-accused in the present crime namely Rakesh Sahu had committed theft of articles worth Rs.7,95.340/-. The allegations against the present applicant are of purchasing the said stolen articles.

The Sessions Court while granting interim anticipatory bail to the applicant, directed him to attend the concerned police station Dinesh S. Sherla 1/2

24-aba-512-23.doc and cooperate in the investigation. It, however, appears from the order of the Sessions Court that the applicant had not attended the concerned police station.

It is thus apparent that the applicant does not want to cooperate in the investigation. The applicant is involved in one more crime of similar nature. Considering the overall facts and circumstances, I am not inclined to release the applicant on anticipatory bail. Hence, the Anticipatory Bail Application is rejected.
