Parties have amicably settled the matter amicably and have filed the consent terms. Consent terms are signed by the Appellant, Respondent and their respective advocates. Both parties are present in the Court. In the consent terms it is provided that parties shall convert the pending divorce petition before the CJSD Court, Dhule into a petition for divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955. It is further agreed that the parties will co-operate each other and file applications for withdrawal and/ or for compounding the complaint filed by the 1 / 2
FCA. 42-15 Appellant-wife under Section 498-A IPC, pending before 2nd JMFC, Shirpur. It is further agreed that permanent custody of the daughter shall remain with the Respondent-father. Consent terms are taken on record. Appeal is disposed of in terms of the consent-terms. 2.
Since, the petition for divorce filed by the parties before the Civil Judge, S. D. Dhule is pending for about six months, we direct that the parties may not be asked to wait for further period of six months, and the petition for divorce may be allowed after its conversion for divorce by mutual consent.
