The application is moved for bail. The applicant/accused is facing charges for the offences punishable under Sections 370(1) of the Indian Penal Code and under Section 4 and 5 of the Prevention of Illegal Traffic Act in C.R. No. 183 of 2015 registered with Aarey police station, Mumbai. The offence is registered at the instance of Police Naik Mr. Prakash Patil on 4th December, 2015. 2.

It is the case of the prosecution that they have received a credible information that the applicant/accused was indulging into the business of prostitution and she is supplying minor girls for 1 / 3

prostitution at her residential premises at Royal Palm, Aarey Colony, Goregaon. Therefore, police led trap with the help of bogus customer on 4th December, 2015 with marked Government currency notes. At that time, it was found that the applicant/accused has supplied one girl for the prostitution and therefore the offence is registered. The applicant/accused was arrested on 5th December, 2015. Hence, this bail application.

The learned counsel for the applicant/accused has submitted that the applicant/accused is innocent. She will not jump the bail. She did not conduct any business of prostitution and no minor victim girl was found in the business of prostitution at her premises.

The learned prosecutor has confirmed that no minor girl was found at the time of raid. She oppose the bail application. 5.

Perused the first information report and statement of victim girl who was found at the time of incident. It appears from the record that no minor girl found at the time of trap. The statement of 2 / 3

other victim girl does not support the case of the prosecution at this stage. Hence, the bail application is allowed on the following terms and conditions:

(a) The applicant/accused be enlarged on bail upon furnishing P.R. Bond in the sum of Rs. 15,000/- with one or two sureties in the like amount.

(b) She shall not tamper with the evidence and shall not pressurize the witnesses.

(c) She shall not indulge into similar criminal activity, while on bail. (d) She shall make herself available and attend all the Court dates regularly.

(e) Violation of any of the conditions imposed shall amount to cancellation of bail forthwith.
