By this petition, the petitioners have impugned the order dated 21st March 2017 passed by the learned adjudicating authority under the Prevention of Money Laundering Act, by which, the provisional attachment order dated 29th September 2016 passed by the respondent No. 2-Directorate of Enforcement, was confirmed. 1/3
When the aforesaid petition was filed, the Appellate Authority constituted under the Prevention of Money Laundering Act was vacant and hence, the petition was filed in this Court. Today, Mr. Venegavkar, learned counsel for the respondent Nos. 1 and 2 states that the Appellate Authority has been constituted, however, the same is not functioning as of today. Learned counsel for the petitioners states that the petitioners have filed appropriate appeals against impugned order dated 21st March 2017 and 29th September 2016 before the Appellate Authority along with interim applications therein. Accordingly, we direct the parties to maintain status-quo with respect to the subject properties/bank accounts till such time, the interim applications filed by the petitioners are decided by the Appellate Authority.
