When this appeal is taken up for hearing, it is noticed that impugned Order dated 26/06/2007 is not in respect of the application at Exhibit 1668 filed by the appellant/accused in the Special Case bearing No.2 of 2003 seeking discharge. We perused the Order at page 295 of the paper-book and noticed that the application for discharge at Exhibit 1668 is not covered by that Order.

(1)APEALNo.10062013.doc In this view of the matter, the learned Counsel for the appellant seeks permission to withdraw the instant appeal with liberty to press his application at Exhibit 1668 for discharge before the Special Court under MCOC Act, Pune.

The appeal is accordingly disposed of as withdrawn with liberty as prayed.

The application at Exhibit 1668 seeking discharge, if pressed by the learned Counsel appearing for the appellant/accused, be decided within a period of four months from the date of communication of this Order to the concerned Special Court.
