Heard Mr. Ponda, the learned counsel for the petitioner, Mr. Rizwan Merchant, learned counsel for respondent No. 1 and learned APP for the respondent State. After hearing both the sides and the learned APP, in my opinion, the following order will serve the interest of justice and will not cause prejudice to any of the parties. Hence I pass the 1/3
following Order:
(1) The application filed by the petitioner for impounding the passport of respondent No. 1;
(2) The application filed by the applicant for cancellation of bail of respondent No. 3;
(3) The application filed by the respondent No. 1 for grant of permission to travel abroad;
and any other incidental applications pending in the Court of Addl. Chief Metropolitan Magistrate's 40th Court, Girgaon, Mumbai, shall be heard by the learned Magistrate on 27/2/2015 and shall be decided on the same day itself. It is further directed that these applications shall be heard in the morning session itself.
Other prayers in the present writ petition are not pressed and they are disposed of as not pressed. The petitioner is at liberty to take out independent proceedings for the same, if advised.
The petition stands disposed of.
