The application is moved by the original complainant for cancellation of order of bail granted to the respondent/accused dated 17.1.2015 passed by the learned Sessions Judge, Pune, below exhibit 10 in Sessions Case No.815 of 2014. 2.
The learned Counsel for the applicant submits that the observations of the learned Sessions Judge were not on merit. The learned Judge has only considered that the accused are in prison for more than one year and chargesheet was filed and also that the trial was not likely to commence soon and therefore,
appln.121.2015_7.doc granted the bail. The learned Counsel has, therefore, prayed that the order granting bail be set aside.

Learned Prosecutor is present and submits to the order of the Court.

Perused the order passed by the learned Sessions Judge. There is nothing on record to show that the accused, who was released on bail, has violated any of the conditions of bail. The bail was granted in 2015. In the circumstances, the application is rejected.
