Heard. This Application is made by the Petitioner - husband for condonation of 1 year and 40 days delay in preferring the Family Court Appeal.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, we are satisfied that the Applicant has made out a case for allowing the present Civil Application. At the same time, the Applicant has to pay cost of Rs.5000/- to the Respondent wife.

Hence, the following order:

25.110.18-cam.doc a) Delay in preferring the Family Court Appeal is condoned. b) The Applicant to pay cost of Rs.5000/- to the Respondent or her advocate within two weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c) Civil application stands disposed off accordingly. d) Office is directed to place the Family Court Appeal on board for admission on 18.06.2018.
