Heard the learned counsel for the parties.

By this application, the applicant is seeking early hearing of the First Appeal No.400 of 2011 on the ground that the applicant No.5-Dattaram Ramchandra Jadhav is a senior citizen.

In support of his contention, the applicant has placed on record a copy of Pan Card.

Considering the submissions made by the learned counsel for the applicant and the averments made in the

40caf1464.doc application, I am satisfied that the applicant has made out a case for allowing the application.

Hence, I pass the following order:

a) Hearing of the First Appeal No.400 of 2011 is expedited.

b) Registry is directed to place the First Appeal for final hearing as per its turn in the list of senior citizen.

c) Civil Application is disposed of. No order as to costs.
