The Petitioner seeks a simpliciter writ of Mandamus to Scrutiny Committee to decide application dated 16 August 2013 for validation of caste certificate.

The Petitioner has entered into the services of the State as Police Constable in the reserved category. The Petitioner would be fully aware that it is the duty of the Petitioner to produce the validity certificate, since he is occupying the post meant for Scheduled Tribe. The Petitioner has moved this Petition six years after filing application for validation of caste certificate, that too, only after the employer has called upon to produce the certificate. 3.

Nothing stopped the Petitioner from approaching this Court

Husen 2 36 WP-2176-2019.doc earlier. Therefore, the direction as sought for time bound disposal, at this stage, cannot be issued. This, however, does not mean that the Scrutiny Committee should not decide the matter at all and will do so within a reasonable time as the caste claim is pending since long. 4.

Writ petition is disposed of.
