1) After arguing for sometime, the learned counsel for the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice.

2) The learned counsel for the applicant submits that applicant would surrender before the concerned Magistrate on or before 10/03/2017. ism

Applicant shall give 24 hours notice to the police before he surrenders and also give notice to the prosecutor in the concerned court. The learned Magistrate shall consider the application on its own merits under section 437 of the Code of Criminal Procedure, 1973.
