2] It is submitted on behalf of the appellant that the earlier order of this Court dated 20th December, 2018 was complied with by the Appellant within the period as directed, but the Affidavit of service was not submitted before the Registry within time. It is, therefore, submitted that since the order has 1/2

(12)CAM-55-2019.doc been complied with and there was mere delay in filing of the affidavit of service, the Civil Application (Stamp) No.29173 of 2018 be restored. 3] Accordingly, Civil Application No.55 of 2019 is allowed. Civil Application (Stamp) No.29173 of 2018 is restored to file and Registry is directed to accept Affidavit of service and place this matter for direction. Matter be listed on 28th February, 2019.
