Mr. Damale, the learned Senior Advocate appearing for the respondent on instructions makes a statement that the respondent shall not create any third party rights in respect of the suit property during the pendency of the suit and the respondent shall not also seek mutation of the revenue records during the pendency of the suit. In view of this statement, the order impugned is modified and the application at exhibit 5 is partly allowed in terms of the statement made. With this order the Appeal from Order is disposed off.
