This is an application for anticipatory bail filed by the aforesaid applicant apprehending his arrest in Crime No.267 of 2015 registered at Paud Police Station, Pune for offences punishable under Sections 302, 120(B) of the IPC and under Section 3(25) & 4(27) of the Arms Act.

Heard Mr. Sarda, the learned counsel for the applicant and Mrs. Mulekar, the learned APP for the State. I have perused the records and considered the submissions advanced by the counsels of the respective parties. The records prima facie reveal that the application for anticipatory bail filed by the aforesaid applicant is pending before the Addl. Sessions Court, Pune. The request made by the applicant to grant him interim bail has been rejected by the Addl. Sessions Judge, Pune vide order dated 16th February, 2016. The learned counsel for the applicant has submitted that the applicant is a

jsn 906 ABA No.341_2016 student and his examination is scheduled from 24th February, 2016 to 29th February, 2016. He has placed on record copy of the time table. 3.

Mrs. Mulekar, the learned APP for the state confirmed the genuineness of the said statement. Considering the above facts, in my considered view, the applicant needs to be protected by way of interim bail till 29th February, 2016.

In view of the above facts and circumstances, the application is allowed on the following terms and conditions. (i) In the event of arrest of the applicant in Crime No.267 of 2015 registered at Paud Police Station, Pune, the applicant shall be released on furnishing bail bonds of Rs.25,000/ (Rupees Twenty five Thousand Only) with one surety in the like amount to the satisfaction of the Investigating Officer.

(ii) The applicant shall not leave Pune district without prior permission of Sessions Court, Pune.

(iii) This order shall remain in force till 29th February, 2016. ( ANUJA PRABHUDESSAI, J. )
