Consequently, First Appeal is dismissed. No costs. 4.

There is a delay of 2 years and 164 days in filing Civil Application (St) No. 5352 of 2012. Although, the Appeal is dismissed, however, heirs and legal representatives of the deceased sole Respondent are to be brought on record as Respondents Nos. 1 to 3 after condoning the delay of 2 years and 164 days. That delay is condoned. Amendment to be carried out within three weeks from today. Civil Application (St) No. 5352 of 2012 is disposed of in these terms.
