This application is filed for grant of anticipatory bail by accused involved in C. R. 319/2017 registered by Daund Police Station, district Pune for the offences punishable under Section 304(2), 279, 337, 338, 427 of the Indian Penal Code and Section 184, 134/177 of the Motor Vehicles Act, 1988.

Heard learned counsel for Applicant and learned APP for Respondent State. I.O. is not present. Applicant is found protected by interim order of this Court dated 27th February, 2018 observing that 1 / 2
9-ABA. 313-18.doc involvement of Applicant is in a road accident when he was riding motor cycle and is found to have given dash to another vehicle driven by Yunus Shaikh, who died in the said impact, and offence came to be registered on the basis of report lodged by pillion rider. 3.
Considering involvement of Applicant as aforesaid and as learned APP makes a statement that investigation is complete and since admittedly Applicant was never called for further investigation, during which period, he was protected by interim order of this Court, application is liable to be allowed. Hence, following order: (i) Interim order dated 27th February, 2018 stands confirmed on the same terms with direction to Applicant to attend I.O. as and when called till filing of the charge-sheet;
