The entire compensation amount is Rs.2,328/-. The appeal was instituted in the year 1999, there was delay of 77 days in filing the appeal. The service upon respondent No.5 was returned unserved with the remark that said respondent No.5 has expired. Without realizing that the amount of compensation is involved in the appeal is so low. The time was taken till date no steps have been taken. Accordingly, for the reasons set out in the Civil Application No.5080 of 2001 in First Appeal Stamp No.12511 of N.S. Kamble page 1 of 2

8-caf-484-2002 1999 and connected matters these Civil Applications and consequently the First Appeal are hereby dismissed. 2.

In view of the dismissal of the appeal, the Civil Application No.485 of 2002 for stay is does not survive and the same is disposed of.

It is made clear that since the dismissal of the Civil Application and the appeal is in circumstances as aforesaid, the same may not be treated as approval the rate awarded by the Reference Court.
