By consent of both the parties, matter is taken for final hearing at the stage of admission.

By this Petition, under Article 227 of the Constitution of India, Petitioner defendant challenges the order dated 07.07.2015 passed by the Appellate Court below Exh.5 in Civil Appeal No. 517 of 2014 directing the defendants to deposit Rs.5,000/- per month by way of interim compensation till the disposal of main Appeal. By consent of both the parties, without giving any reasons, the order passed by the Trial Court is modified as follows:

914 wp 3433-16=.doc a) Petitioner Defendant to deposit in this Court sum of Rs.3,000/- per month by way of interim compensation instead of Rs.5,000/- as directed by the Appellate Court by order dated 07.07.2015.

b) An arrears up to March,2016 to be deposited in the Trial Court within six weeks from today, failing which interim protection granted by order dated 07.07.2015 by District Judge-10, Pune shall stands vacated.

c) Hearing of Civil Appeal No. 517 of 2014 is expedited.

d) Writ Petition stands disposed of accordingly.
