Learned APP has produced a copy of the impugned order dated 07.01.2016 passed by the learned Additional Sessions Judge, KhedRajgurunagar below Exh.125 in S.C.No.92 of 2014. Same is taken on record and marked as "X" for identification. He submits that the present Application seeking re-call of the complaint and other witnesses has been partly allowed by the learned Additional Sessions Judge.

From a perusal of the said order, it appears that the learned Judge has given an opportunity to the Applicant to cross examine the witnesses and in fact, had partly allowed the Applicant's Application for re-call of witnesses, by re-calling the investigating officer.

Perused the papers. There is no infirmity in the said order. Accordingly, the Application is dismissed.

Registry to communicate the said order to the learned Judge, who is seized of the matter, as well as to the Applicant, who is lodged in Yerwada Central Prison, Pune.
