The present First Appeal is preferred by the State of Maharashtra challenging the judgment and award dated 17.09.2004 passed by the Employees Insurance Court at Mumbai in Application (ESI) No. 18 of 1996 holding that respondent claimant is entitled to sum of Rs. 50,000/- towards reimbursement of medical charges with interest @ 6% per annum.

First Appeal is dismissed as withdrawn. No order as to costs.

Refund of court fees according to law.

In view of withdrawal of First Appeal, nothing survives in the Civil Application. Same stands dismissed as infructuous.
