Heard learned counsel appointed for the Applicant. Learned counsel vehemently submits that in the interest of justice, the prayer of the Petitioner to transfer the matter to any other court from court room no. 55, Sessions Court, Mumbai be granted.

2) It appears from the records that by an order dated 08/08/2014 case of the petitioner was transferred under section 11 of MCOC Act to the Regular Court, having jurisdiction under Code of Criminal Procedure, 1973 and it was directed that the petitioner be tried for offence punishable under sections 365, 302, 201, 420, 457, 465, 468, 471, 380, 364, 342, 404, 392 read with 34 of Indian Penal Code, 1860. Thereafter, on 21/01/2016 petitioner had filed an ism

2 30.123.16 appln application that it be transferred from court room no. 55 to any other court. 3) An accused would have no choice to select the Court. In view of this, Application being sans merits, stands rejected. 4) The professional fees of learned counsel appointed for the Applicant is quantified to the tune of Rs. 1000/- to be paid to him within 3 months from today.
