Mr. Vechalekar submits that respondents have secured possession of the suit premises. Mr. Singh confirms the said fact. As the applicants have surrendered possession of the suit premises to the respondents, Civil Application is allowed in terms of prayer clause (a). Writ Petition No.5177 of 1996 is restored to its original 1/2

CAW466_18.doc position. Respondents shall neither create third party interest nor part with possession and will abide by the outcome of the main Petition. Civil Application is disposed of.
