Heard the learned Advocates for the parties and by consent, the following order is passed :

(i) Petition No.A-2013 of 2013 filed by the Applicant before the Family Court at Bandra is transferred to the Court of 2nd Joint Civil Judge, Senior Division, Kalyan and to be heard along with Marriage Petition No.949 of 2013 filed by the Respondent before the Kalyan Court seeking restitution of conjugal rights. (ii)The Registrar, Family Court at Bandra shall ensure that the papers and proceedings of Petition No.A-2013 of 2013 reach the Court of 2nd Joint Civil Judge, Senior Division, Kalyan on or before 25th September, 2017. iii.

Parties and / or their Advocates shall appear before the 2nd Joint Civil Judge, Senior Division, Kalyan on 27th September, 2017 at 11.00 a.m. and obtain ssp 1/2

mca 86 of 2016 (23).sxw appropriate orders / directions.

iv.

The learned 2nd Joint Civil Judge, Senior Division at Kalyan shall endeavour to dispose off Petition No.A-2013 of 2013 and M.P.No.949 of 2013 within a period of six months from 27th September, 2017. v.

The 2nd Joint Civil Judge, Senior Division shall not grant adjournment/s to either side unless absolutely necessary. The parties too shall not apply for adjournment/s unless absolutely necessary.

vi.

All contentions of the parties are kept open. vii.

The parties as well as the learned 2nd Joint Civil Judges, Senior Division, Kalyan and the Family Court at Bandra to act on an authenticated copy of this order. viii.

The above Misc. Civil Application is allowed in the aforesaid terms, with no order as to costs.
