The applicant has been convicted under section 302 for causing murder of Bappa Sitaram. The applicant is now seeking bail. 3.

There are two eye witnesses to the incident, i.e., PW-1 Keshav and PW-6 Chandan Kumar. These witnesses have stated that on 13th November, 2012 at about 1.30 a.m. the applicant assaulted Bappa Sitaram,

906.APPA257_2016 who was sleeping on the footpath, with a stick. Thereafter, the applicant assaulted Bappa Sitaram with stone on his head. Due to assault on the head, the skull was fractured. There was also contusion in the occipital and parietal region, which were 5 X 5 X 1 cm in size. The deceased had also sustained some other injuries. Looking to the evidence on record, we do not think this is a fit case to grant bail.
