1) This is an application under section 439 of the Cr.P.C. for bail in CR No.504/2016 dated 28.10.2016 registered with Powai Police Station, Mumbai under Section 370(3) read with 34 of the Indian Penal Code, under Section 3,4,5,7,(1)(b) of the Immoral Traffic (Prevention) Act, 1956 and under Section 67 of the Information Technology Act.
2) It is the prosecution case that after receiving confidential information that, prostitution business was being carried out at hotel Relax-in and that by publishing an advertisement on website certain persons were conducting the said business, police deputed bogus customer. That, in pursuance of the further information received and or steps taken by the police it ultimately led the police party to hotel Relax-in situated at Powai,
2 /3BA-474-17-42 Mumbai. The police thereafter conducted raid in the said hotel. That, five victim women were found at the said place. The role attributed to the applicant in the present crime is that he was acting as a tout and used to take victim girls to the said hotel on the directions of co accused Sham. That the applicant used to collect part of the money received by the said victims and is living on the income derived from the business of prostitution. The applicant was arrested on 28.10.2017. After completion of investigation the police have submitted charge sheet.
3) I have perused the charge sheet annexed to the application. The statements of the victims disclose that they were present at the spot and were indulging into said profession at their own volition. As stated earlier the role attributed to the applicant is that of agent of the said victims.
4) The applicant was arrested on 28.10.2016 and since then he is in jail. It is reported that there are no antecedents at the discredit of the applicant. In view thereof the applicant has made out a case for his release on bail.
5) Hence, the following order.
a) The applicant be released in bail in CR No.504/2016 dated 28.10,.2016 registered with Powai Police Station, Mumbai on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.
3 /3BA-474-17-42 b) After his release from Jail the applicant shall attend the Powai Police Station, Mumbai on every first Monday of the month between 11.00 a.m. to 1.00p.m. till the completion of the trial.
c) The applicant shall not tamper with the evidence and or influence the prosecution witnesses.
d) Application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
