Heard. This is an application under section 438 of Code of Criminal Procedure, 1973. Applicants herein are apprehending their arrest in crime no. 175 of 2014 registered at D. B. Marg Police Station for offence punishable under sections 465, 467, 468, 471 & 420 r/w 34 of Indian Penal Code. 2) At the threshold, learned counsel for the applicants has submitted that complainant in the present case, namely Harakhchand Gala and two others who were affected had appeared before Senior Inspector of Police, D. B. Marg Police Station and had submitted that complainant and applicants have arrived at amicable settlement. Applicant no. 3 has also filed a writ petition ism
2 9.296.15 aba before Hon'ble Division Bench seeking quashing of F.I.R. by consent. 3) In view of this, merits of the matter need not be gone into as Investigating Officer who is present in the Court also has submitted that pursuant to the order passed by this Court on 16/06/2015, Investigating Officer has personally recorded the statement of complainant and it is submitted by the complainant that parties to the petition have arrived at an amicable settlement. In view of this, custodial interrogation would not be imperative.
O R D E R
(i) Application is allowed.
(ii) In the event of arrest, applicants be enlarged on bail on furnishing P. R. bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.
(iii) Applicants shall report to concerned police station as and when called.
(iv) Application stands disposed of.
