Heard learned counsel for the applicant and learned APP.

This is an application for pre-arrest bail. The applicant is apprehending arrest in connection with C.R.No.83 of 2023 dated 30/01/2023 registered with Tilaknagar Police Station for offence punishable under sections 326, 504, 506 and 34 of the Indian Penal Code, 1860.

It is alleged that the present applicant along with his friend woke up the complainant at around 5.30 a.m. on 30/01/2023 and asked for a cigarette. The complainant 1/2

Urmila Ingale 907-aba-539-23.odt stated that shop is closed and it is not possible for him to give cigarettes at that hour. The applicant and his friend were annoyed. The applicant gave blow on the head of the complainant with a beer bottle. The applicant's friend hit the complainant on a face with stick which was lying nearby. The complainant suffered injury (CNW) on his head. No doubt, injury is simple in nature. Considering that the assault by the present applicant was on vital part of the body, I am not inclined to grant this application. The application is rejected.
