The impugned order is passed by the Commissioner in exercise of power under section 257 of the Maharashtra Land Revenue Code, 1966 against which the petitioners have alternative efficacious statutory remedy by way of second revision under section 257 of the Maharashtra Land Revenue Code, 1966. 2.

Hence, by keeping all questions raised in the writ petition open to be agitated before the Minister, the writ petition stands disposed of. No costs.

It is made clear that existence of Model Code of Conduct shall not preclude the Minister or the Secretary from deciding quasi-judicial matters under section 257 of the Maharashtra Land Revenue Code, 1966.
