This Contempt Petition has been filed by the original Appellant in the Family Court Appeal on the ground that the Respondent husband has willfully and deliberately committed a breach of the order dated 28th November, 2016 passed in Civil Application No.280 of 2015 in Family Court Appeal No.135 of 2010. By this order, a Division Bench of this Court had directed the Respondent husband to pay maintenance Aswale 1/2

22.cp.87.17.doc to his wife and two children @ Rs.25,000/- per month from the date of the said order.

Since this order was not complied with, the present Contempt Petition came to be filed.

It is now common ground before us that up to April 2018 the entire amount of the maintenance calculated @ Rs. 25,000/- from December 2016 to April 2018 has been paid.

Considering these facts, we do not think that there is any necessity to proceed further with this Contempt Petition. Hence, the Contempt Petition stands disposed of.

However, it is made clear that the Respondent husband shall continue to pay maintenance of Rs. 25,000/- per month to his wife and two children as directed by this Court in its order dated 28th November, 2016. If the Respondent husband fails to comply with these directions, the Appellant wife is at liberty to take further action as she may be advised.

Contempt Petition stands disposed of.
