Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

"4(i) The delay of 13 days in filing the present appeal from order impugning the order of the ld. 3rd Asst. Civil Judge, Nashik Court inter alia in Application Exhibit "5" in Special Civil Suit No. 113 of 2014, be condoned."

ii) Rule made absolute accordingly.

iii) No order as to costs.

iv) Civil application stands disposed off accordingly.
