Applicant seeks his pre-arrest bail in connection with Crime No. 197/2018 registered with Talegaon Dabhade Police Station for the offences punishable under Sections 307, 143, 147, 148, 149 of the Indian Penal Code along with Sections 4(25), (27) of the Arms Act and Section 135 of the Bombay Police Act.

The alleged incident had taken place on

Rane 2/2 ABA-593-2020 (SR.905) 11 March, 2020.

th April, 2018. Out of six accused, four were arrested and one is absconding. Applicant is accused no.3 and seeks pre-arrest bail. Pending application, the learned Sessions Court below had not granted interim relief to the applicant.

Though, it is submitted that the chargesheet has been filed against the accused who were arrested, the fact remains that the applicant was armed with a weapon like gupti and the same is yet to be recovered. One of the injuries, as per the Medical Certificate, is found on the occipital region. Thus, taking into consideration the nature of accusations and the conduct of the applicant, the application is hereby rejected.

It is made clear that observations made hereinabove shall be construed as expression of opinion only for the purpose of refusal to grant bail and the same shall not in any way influence the trial in other proceedings.
