On expressing my disinclination to entertain the application in the wake of the material compiled in the chargesheet, learned counsel Mr.Ayaz Khan, seeks permission to withdraw the application.

He, however, submits that the applicant is arrested on 16/09/2019 and till date, even the charge has not been framed. Relying upon the authoritative pronouncement of the Hon'ble Supreme Court as regards the long incarceration in absence of M.M.Salgaonkar

2/2 3 BA-981-21.doc the trial, he would submit that the trial shall be directed to be concluded in a time bound manner.

Since the applicant is incarcerated for last three years, the Special Court (NDPS) dealing with Special Case No.418 of 2020, is requested to frame the charge within a period of three months from today and conclude the trial within a period of one year thereafter.

Failure to conclude the trial within the period stipulated would entitle the applicant to renew his request for being released on bail.
