Heard learned counsel for the Applicant.

By this Application, the Applicant seeks relaxation of the condition of attendance, which was imposed vide order dated 10.10.2014 by the learned Additional Sessions Judge, City Civil & Sessions Court, Greater Mumbai. He submits that while enlarging the Applicant on bail, the learned Judge was pleased to impose the following conditions:

Applicant is directed to attend police station once in a month i.e., first Monday of every month instead of attending twice in a week.

Failure of attending the police station would result in cancellation of bail granted to him."

He submits that thereafter, the Applicant moved an Application seeking relaxation of his condition of attendance on the first Monday of every month on the ground that charge-sheet is filed. The said Application was rejected by the learned Additional Sessions Judge, City Civil & Sessions Court, Greater Mumbai. Hence, this Application.

It appears that charge-sheet is filed.

It is also not in dispute that the Applicant has been attending the concerned police station on the first Monday of every month from the date he

was enlarged on bail i.e. from October, 2014. 5.

Considering the peculiar facts of this case, the Application is partly allowed to the extent that the Applicant shall, now, attend the concerned police station on the first Monday of every alternate month, instead of the first Monday of every month.

Accordingly, the Application is disposed of.

Parties to act on the authenticated copy of this order.
