Learned counsel appearing for the applicant informed this Court that he has been orally instructed to state that the matter is settled with the respondent no.1, however, he seeks time to take instructions in writing from his client.

Learned counsel appearing for the respondent no.1 tenders a copy of the letter dated 31st March, 2016 addressed by the applicant and two others for settlement of the dispute. She submits 1/2

8-car16-16 that the respondent no.1 has accepted the proposal of the applicant and two others. She submits that the applicant and two others have also started making payment of installments in accordance with the said settlement arrived at between the parties. The letter dated 31st March, 2016 is taken on record. The statement made by the learned counsel for the respondent no.1 is accepted.

In view of the statement made by both the parties, the civil application filed by the applicant for condonation of delay as well appeal do not survive. The civil application as well as the arbitration appeal are disposed of accordingly. No order as to costs. (R.D. DHANUKA, J.) 2/2
