After arguing for some time, the learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. Learned APP also submits that the charge is framed and witness summons have been issued. It appears from the record that the case is committed to the court of Sessions in the year 2013 and it is registered as Sessions Case No. 471 of 2013. In view of this, the learned Sessions Judge, Thane, seized with the Sessions Case No. 471 of 2013 shall make Talwalkar 1/2

20.ba366.16.sxw every endeavour to conclude the trial in this case as early as possible and expeditiously. The learned Sessions Judge shall not grant unwarranted adjournment to either prosecution or to defence and shall also ensure that the accused is produced on each and every date at the time of trial, failing which the learned Sessions shall take appropriate action.

The application stands dismissed as withdrawn and disposed of accordingly.
