Mr.Jamdar, learned Counsel for petitioner, on instructions, states that the petitioner is withdrawing the original Civil Suit No.415 of 2005 filed before the Small Causes Court at Pune. Mr.Kanetkar, learned Counsel for respondent No.1, states that in fact, a pursis to that effect has been filed in connected proceeding (Special Civil Suit No.1652 of 2007). Pursis is placed on record. Learned Counsel for the parties have also placed on record "No Due Certificate" dated 3rd January 2018.

In view of the withdrawal of the suit, all proceedings thereunder would come to an end. This Writ Petition therefore becomes infructuous. Writ Petition is disposed of as infructuous. [G.S. KULKARNI, J.]
