This First Appeal is filed by the Union of India as owner of Central Railway against M/s. Hindustan Petroleum Co. Ltd. 2.

The Respondent had filed application under Section 16 of Railway Claims Tribunal Act, 1987 claiming compensation towards short delivery. The said application was allowed. The Appellant was directed to pay compensation of Rs.11,325/- to the Respondent along with interest at the rate of Rs.12% per annum by the order dated 17.04.2001.

When the Appeal was called out on 21.12.2023, the Court recorded that the learned counsel sought permission to take photocopy of the Appeal paper-book from the Court paper-book. This Court allowed the said exercise.

However, today when the matter is called out, none appears for any of the parties. Looking to the amount involved in the Appeal, it appears that no party has any interest in this Appeal. 5.

For the reason, this Court finds that keeping the Appeal pending would be of no avail. The Appeal is therefore dismissed for want of prosecution.
