The learned Additional Public Prosecutor Mrs.Pai states that pursuant to our last order dated 10th July, 2018, the Petitioners have refunded the amount to the four investors i.e. the First Informant and three others in the presence of the Investigating Officer, P.I. - Sanjay Mohite of L.T. Marg Police Station, Mumbai. She further states that the Investigating
2/2 907-wp.895.2018.doc Officer has recorded the statements of the four investors of having received the said amount as also has confirmed the receipt of the amount on the basis of the Bank Statements of the four investors. She lastly states on instructions of the Investigating Officer, P.I. - Sanjay Mohite, who is personally present in Court that he would be filing an appropriate report under Section 169 of the Code of Criminal Procedure, in the concerned Trial Court, during the course of the present week. 2.
In view thereof, it is not necessary to keep the above Writ Petition pending. The same to accordingly stand disposed of. Liberty to the parties to apply in case of difficulty.
