Heard Mr. Gite, learned Counsel for the applicant. Non-applicant is absent, though served.

Applicant seeks transfer of Hindu Marriage Petition No. 573/2018 from the Court of Civil Judge Senior Division, Kalyan to the Family Court at Nashik and to be heard alongwith Hindu Marriage Petition No. 490/2018 filed by the non-applicant.

Applicant is residing at Kalyan; whereas, nonapplicant at Nashik. Both are seeking dissolution of marriage.

Therefore, to avoid overlapping of evidence, it would be appropriate to transfer the petition filed by the applicant from the Court of Civil Judge Senior Division, Kalyan to the Family Court at Nashik. In that view of the matter the application is allowed. Thus, the following order :

O R D E R

(i)Hindu Marriage Petition No. 573/2018 stands transferred from the Court of Civil Judge Senior Division, Kalyan to the learned Family Court at Nashik.

(ii)The Learned Judge, Family Court, Nashik shall decide Hindu Marriage Petition No. 573/2018 filed by the husband and Hindu Marriage Petition No. 490/2018 filed by the wife, together.

(iii)The Registrar, Civil Judge Senior Division, Kalyan shall ensure that the Hindu Marriage Petition No. 573/2018 is transferred to Family Court, Nashik within four weeks from today.

The application is allowed and disposed of.
