CORAM: SMT. VASANTI A. NAIK & SHRI C. V. BHADANG, JJ.
DATED : 4TH MARCH, 2015 P.C.:
Heard.
By this petition, the petitioner seeks action against the respondents for wilful disobedience of the order dated 28th February, 2013 passed in the writ petition filed by the petitioner. It is stated on behalf of the respondents that the impugned order has been complied with and by the order dated 8th September, 2014, the application filed by the petitioner for grant of alternate land is rejected as the petitioner did not supply all the
bsb 2 CP449.14.doc necessary documents that were directed to be supplied by the notice dated 20th June, 2013. It is stated that, since all the relevant documents were not supplied, the application of the petitioner was rejected.
On hearing the learned Assistant Government Pleader, it appears that no action under the provisions of the Contempt of Courts Act could be initiated against the respondents for wilful disobedience of the order dated 28th February, 2013. The respondents have rejected the application filed by the petitioner. If the petitioner is aggrieved with the order rejecting the application, the petitioner has other remedies, however, the same cannot be a matter of contempt.
In view of the aforesaid, the contempt petition stands disposed of with no order as to costs.
