The Petitioner has challenged the order passed by the learned Civil Judge, Senior Division, Thane, dated 5 December 2015, dismissing the suit. The Petitioner will have to take out substantive proceedings to challenge the impugned order of dismissal of the suit. Since that remedy is available to the Petitioner, the writ petition need not be entertained and is accordingly disposed of, keeping the remedies of the Petitioner open as regard the impugned order, as per law.
