By this Civil Application, the applicant is seeking condonation of 49 days delay in filing First Appeal challenging the Judgment and Decree dated 1st September 2016 passed by the City Civil Court, Mumbai in Suit No.7560 of 2003 (H.C.Suit No.4084 of 2003).

Considering the submissions made by the learned counsel for the applicant and the averments made in Civil Application, I am satisfied that Applicant has made out a case for
