On account of 11 days' delay in filing the Second Appeal, Civil Application is taken out seeking relief of condoning the delay.

Perused the said application and in particular the contents of paragraphs 12 and 13 reveal that the Applicant was diligent in prosecuting the remedy of filing the Appeal and in particular paragraph 13 contain an explanation about the steps taken by him in filing the Appeal. Since the delay has been sufficiently explained by offering sufficient justification and in my opinion, the same being bonafide, needs to be condoned. 3.

Learned counsel for Respondent No.6 who has put in his appearance though opposed the prayer for condonation of delay, in the interest of justice, Civil Application No.1456 of 2018 is allowed in terms of prayer clause (a). Registry is directed to register the appeal and list it for admission after two weeks. 4.

It is also informed by learned counsel for Respondent No.6 that Second Appeal No.317 of 2019 revolves around the same impugned judgment and be tagged along with this appeal. 5.
