For the reasons stated in the application, the application is allowed. The names of the legal heirs of the respondent No.1, as are stated in the application, are permitted to be brought on record. The learned counsel appearing for them waives service of notice.

Second Appeal No.521 of 1994 :

The learned counsels appearing for the parties submit that the second appeal itself is settled between the parties out of Court and neither the grievance of the appellant nor the grievance of the respondents survive.

The second appeal stands disposed of.
