Heard. By this Civil Application the Applicant husband is seeking early hearing of the First Appeal. He submits that the Family Court Appeal has already been admitted by this court on 02.05.2016 and directed the Appellant - wife to file private paper book within six months from the date of the said order. He submits that till today the paper book has not been filed by the Appellant. At this stage, the learned counsel for the Appellant submits that the Appellant - wife is ready and willing to file the paper book as per order dated 02.05.2016, on or before 13.12.2019. The statement is accepted.

10.85.19-cam.odt Considering the submissions made by the learned counsel for the Applicant and the averments made in the Civil Application, we are satisfied that the Applicant has made out a case for allowing the Civil Application. Hence, following order is passed:

a.

The Appellant wife shall file private paper book on or before 13.12.2019, with copy to other side, failing which the Family Court Appeal shall stand dismissed without further reference to the court.

b.

Hearing of the Family Court Appeal is expedited. c.

The Civil Application stands disposed of accordingly. No order as to costs.

d.

Place the Family Court Appeal on board on 19.12.2019, for directions, if paper book is filed within time.
