Learned APP submits that on the basis of C.A. report section 22(c) of N.D.P.S. Act has been invoked in this case. Learned advocate for the applicant submits that since there is change in the circumstances, the applicant may be permitted to prefer a fresh application before the Special Court.

Considering the aforesaid circumstances, the applicant is permitted to withdraw this application with liberty to prefer a fresh application before the Special Court. The Special Court may entertain a fresh application of the applicant and decide it in accordance with law.
